Employment Dispute Resolution (Spring 2018)

Course Description

Co-taught with Gail Glick and Marvin Krakow

The Employment Dispute Mediation course provides a series of simulated mediation experiences combined with a general survey of substantive employment law and the procedural rules governing mediation.  The course will begin with an introduction to the statutes, regulations and cases governing common employment disputes with a particular emphasis on anti-discrimination law, whistleblower protection, and employer accommodation of disabilities and religious practices.  Preliminary readings will also include rules and procedures governing mediation of employment disputes, including mediation confidentiality.  Following classroom discussion of those preliminary materials, students will participate in collaborative exercises which simulate aspects of the mediation of employment matters, specifically, counseling clients about mediation, drafting mediation briefs, communications during mediation sessions, negotiation tactics, and drafting agreements.  The collaborative exercises will incorporate classroom critiques.  Additional readings will focus on negotiation tactics and strategy.

Seven classes on Mondays from 5:00-6:50.  Class will be held January 8, 22, and 29, and February 5, 12, and 26, and March 5.  Classroom: Room 130

E.Credit and Grading

This course will be a 1 unit course of seven class sessions, from 5:00-6:50 on Monday evenings. The first class will be January 8 and the last class will be March 5.  The course will be offered only on a CR/D/F basis.

The class will not be recorded.

H.    Course Objectives

By the conclusion of this course, students will have a general familiarity with the law governing employee rights and employer obligations, and a practical sense of how to advocate on behalf of employees and employers in the context of mediation.  Skills in employment mediation will be generally transferable to mediation of other disputes.

II.  Course Requirements & Guidelines

A.Class Preparation and Participation

Class discussion will commence with the assumption that everyone is thoroughly familiar with the assigned materials and is prepared to participate in discussions and simulations in a professional manner. 

B.Attendance and Classroom Behavior

Regular and punctual attendance is expected of all students.  The work of the course is primarily participatory and collaborative.  Please note that all communication and entertainment device functions such as cell phones, iPods, and iPads are to be turned off and kept off throughout the class session. However, students are permitted to take notes on electronic devices during the course.

C.Grading Criteria

There will be one paper and no exams. 

(10%)  Class attendance.

(15%)  A short (4-6 page) paper/mediation brief, double spaced, based on a mock employment dispute. 

(75%)  Class participation in simulated mediation exercises.  Note: participation will require collaboration with other students.

The course will be offered only on a CR/D/F basis.
